مسألة تكرار الجرائم بين قانون العقوبات وقوانين الحدود (دراسة في التشريع الليبي

قوانين الحدود الليبية تقع في إطار تغييرات تشريعية نحو تطبيق أحكام الشريعة الإسلامية تمت في بعض الدول العربية، حيث إن العديد منها تبنى نظامي الحدود والقصاص والدية، كالقانون اليمني، والقانون السوداني، إلا أن هذه التشريعات لم تتبع منهجا واحدا في ذلك. فبخلاف قانون العقوبات لدولة الإمارات العربية المتحدة الصادر في سنة 1987، الذي نص في مادته الأولى على أنه: (تسري في شأن جرائم الحدود والقصاص والدية أحكام الشريعة الإسلامية، وتحدد الجرائم والعقوبات التعزيرية وفق أحكام هذا القانون والقوانين العقابية الأخرى)، اختار المشرع الليبي طريق تقنين أحكام الحدود والقصاص والدية في نصوص واضحة ومنضبطة، على غرار ما اتبعه في نظام التعزير، حتى يسهل على الفرد معرفتها، والقاضي تطبيقها، على نحو يكفل الوحدة القانونية في البلد الواحد. كما أن مبدأ شرعية الجرائم والعقوبات يوجب تحديد المشرع للجريمة وعقوبتها، وأن لا يترك ذلك للقاضي ليبحث عنه في الفقه الإسلامي، الأمر الذي قد يفضي إلى اختلاف القضاة في ذلك، نتيجة لاختلاف الآراء الفقهية، واختلاف القضاة في الراجح والمرجوح.
