قراءة في نصوص الإحالة و موقف المحكمة العليا منها وموقف المحكمة العليا منها

إن قلة النصوص في تشريعات الحدود، ولجوء المشرع إلى النص لتكملة أحكامها بالرجوع فيما لا نص فيه إلى أحكام الشريعة الإسلامية، تجعل موضوع الإحالة بالغ الأهمية، وحرياً بالدراسة والوقوف عنده، لاسيما أن نصوص الإحالة بمـا هـي عليه في تشريعات الحدود، تجعلنا إزاء إشكالية حقيقية، تكمن هذه الأخيرة في إثارة موضوع غاية في الأهمية، يتسلط على مدى خضوع وانسجام هذه مبدأ الشرعية، هذا من جانب، ومن جانب آخر مدى كون هذه النصوص تمثل حجر عثرة في طريق تطبيق تشريعات الحدود والتزام أحكامها. نحن نعلم أن النظام الجنائي في أقسامه المختلفة، يقوم على عدد من المبادئ الأساسية، منها ما يتعلق بمصدر هذا النظام، ومنها ما يتصل بقواعده الموضوعية، ومنها ما يتعلق بالقواعد الإجرائية فيه.
