التنظيمات الإدارية في وزارة الدفاع الليبية - في العهد الملكي ، 1952-1967م

تحصلت ليبيا على استقلالها حسب قرار الجمعية العامة للأمم المتحدة الصادر بتاريخ 1951/12/24م (1) وقبل هذا التاريخ عكف الليبيون على اصدار دستور دولتهم الذي صدر في 1951/10/8م لينص على أن تكون ليبيا مملكة متحدة نظامها وراثي وشكلها اتحادي الدول الإسلامية. وجاء في الفصل الثالث من هذا الدستور وفي الفرع الأول المادة ستة وثلاثون : أن يتولى الاتحاد الليبي السلطات التشريعية والتنفيذية المتعلقة ببعض المسائل والتي من ضمنها :- الشؤون المتعلقة بالحرب والسلم ، وإعداد القوات البرية والبحرية والجوية وتدريبها والانفاق عليها واستخدامها والاشراف على المنشآت الخاصة بهذه القوات ، والأسلحة الخاصة بالدفاع الوطني بأنواعها بما في ذلك الأسلحة النارية والذخائر والمفرقعات. ونص الدستور الليبي أيضاً في المادة الثامنة والستين بأن الملك هو القائد الأعلى لجميع القوات المسلحة الليبية ، كذلك صدر في نفس اليوم الذي تم فيه اعلان استقلال ليبيا ما عرف بالإعلان الرابع رقم 194 والاعلان 223 والذي جاء فيه : تنقل آخر السلطات المتعلقة بالشؤون الخارجية والدفاع من قبل الحكومتين البريطانية والفرنسية إلى الحكومة الليبية المؤقتة والتي تم تشكيلها برئاسة السيد محمود المنتصر.
