ولاية المرأة على أولادها القصر في التشريع الليبي

عندما استقلت ليبيا عن إيطاليا، شرعت في إصدار التشريعات الخاصة بها، حيث صدر القانون المدني، و كذلك قانون المرافعات المدنية والتجارية سنة 1953 في، كما صدرت تشريعات أخرى تنظم مختلف المجالات والعلاقات. إلا أنه فيما يتعلق بالأحوال الشخصية والمسائل المتعلقة بالوقف فقد نص قانون نظام القضاء رقم 29 لسنة 1962 في على أن تطبق عليهما أحكام الشريعة الإسلامية طبقا للمشهور من مذهب الإمام مالك، وأعاد المشرع هذا الحكم في المادة 159 من القانون رقم 51 لسنة 1976ف بشأن إصدار نظام القضاء، ومن ثم فإن القانون الذي كان مطبقا آنذاك هو المشهور من مذهب الإمام مالك، واستمر الحال في مسائل الأحوال الشخصية إلى أن صدر القانون رقم 122 لسنة 1971 في، بشأن تيسير الحصول على النفقات الشرعية، الذي نظم فيه المشرع الأوامر التي يصدرها القضاة بشأن النفقات، وطريقة الاعتراض عليها، كما أصدر المشرع القانون رقم 176 لسنة 1392 ه. 1972 م في شأن كفالة بعض حقوق المرأة في الزواج والتطليق للإضرار والخلع، حيث نظم المشرع بعض المسائل المتعلقة بهما .
