The Principle of Justice as a Basis for Implementing The Law

Abstract

     The study aims to enhance the concept of achieving and developing justice according to different systems and the extent of its impact on modern legislation and Islamic Sharia, considering that justice is the essence of the law. Justice has appeared as a tool for developing laws among ancient and modern peoples, and justice has also appeared as a factor in developing laws in Islamic Sharia in various shapes and forms, whether at the level of legislating rulings or at the moral level and regulating relations between individuals with each other or between them and the ruler.  Several methods were used in this research, including the historical method: in which the historical development of the idea of justice over the ages was discussed, and the analytical method: which describes and analyzes the impact of justice in the application of legal systems, and the researcher reached several results, the most important of which is that justice has become, in most countries of the world, a source of their laws, and justice has also had an impact in the field of judiciary and in the field of developing contemporary laws because it derives its strength from people’s belief in its necessity to achieve the interests of society, and It was concluded from this research that justice is a basic social rule for the continuation of human life with each other. It is the main axis of morals and rights because justice is the basis of property and the basis of a cohesive society, and where there is justice, there is happiness and reassurance for all peoples
