The Legal and Regulatory Framework of The Chambers of Commerce, Industry, and Agriculture in Libya

an Analytical Study in Light of Law No. (23) of 2010 and its Executive Regulation

Abstract

This research presents an analytical study of the legal and regulatory framework for the Chambers of Commerce, Industry, and Agriculture in Libya, in light of Law No. (23) of 2010 and its executive regulation issued by Decision No. (333) of 2012. It highlights the vital role of these chambers in supporting the private sector and regulating economic activity, as they are independent legal entities with broad legal powers encompassing representation, service provision, qualification, and dispute resolution. The research is divided into two main sections. The first section is concerned with analyzing the legal status and composition of the chambers, membership conditions, internal organizational structure, and financial resources. The second section addresses the legal and regulatory relationship between the chambers, the General Union of Chambers, and the Business Owners Council, focusing on mechanisms for coordination and mutual cooperation. The research adopts an analytical descriptive methodology and aims to bridge the knowledge gap in legal studies related to the institutional and regulatory aspects of the Libyan business environment. It also provides recommendations for developing the legal framework to enhance the role of these chambers in achieving sustainable development.
